AI Regulatory Compliance Framework
Overview
As of 2026, global enterprises face a complex environment requiring simultaneous compliance with AI regulations across multiple jurisdictions:
- EU: AI Act (adopted 2024, phased application 2025-2027: prohibitions Feb 2025, GPAI obligations Aug 2025, general application and Annex III high-risk Aug 2026, Annex I high-risk Aug 2027)
- United States: NIST AI RMF 1.0 (voluntary framework), applicable federal and agency procurement policies, state-level regulations
- Korea: AI Framework Act (AI 기본법, in force since 22 January 2026)
- International Standard: ISO/IEC 42001:2023 (AI Management System certification)
Why AIDLC Integration is Essential
Direct mapping of regulatory requirements to AIDLC process stages enables:
- Traceable Control Coverage: Traceable mapping of required controls to each stage (mapping aids compliance but does not guarantee it automatically)
- Unified Audit Trail: Single audit tracking system for all regulations
- Efficient Updates: Only modify AIDLC stage definitions when regulations change
- Evidence Collection Support: Supports generation of compliance reports
Four Framework Summary
EU AI Act (2024-2027)
Key Features:
- World's first comprehensive AI regulation (legally binding)
- 4-tier risk classification (Prohibited/High-risk/Limited/Minimal)
- Strict obligations for High-risk AI systems (risk management, data governance, technical documentation, automated logging, transparency, human oversight, robustness)
- Penalties: Up to 35M€ or 7% of global annual turnover
AIDLC Application:
- Inception: Risk Tier classification, risk management plan
- Construction: Auto-generation of technical documentation, audit logs, robustness testing
- Operations: Post-market monitoring, incident reporting (Art. 73; 15 days generally / 2 days severe / 10 days where a death is involved)
NIST AI RMF 1.0
Key Features:
- Published by U.S. NIST; voluntary adoption is distinct from obligations in laws, agency policies, and contracts
- 4 Functions: GOVERN, MAP, MEASURE, MANAGE
- The Generative AI Profile (NIST AI 600-1, July 2024) is a companion to AI RMF 1.0
- International compatibility (interoperable with ISO/IEC 42001)
AIDLC Application:
The four Functions are iterative rather than one-time sequential stages, and GOVERN and MANAGE in particular run continuously across all stages. The mapping below shows where each Function is especially concentrated.
- Inception: GOVERN + MAP (governance & risk identification)
- Construction: MEASURE (performance, bias, robustness evaluation)
- Operations: MANAGE (risk response & continuous monitoring)
ISO/IEC 42001:2023
Key Features:
- International AI Management System standard (certifiable)
- PDCA-based (Plan-Do-Check-Act cycle)
- 38 controls under nine control objectives, A.2 to A.10 (Annex A; checked against published secondary sources as of 2026-10-29, not the paid normative text)
- Integrable with ISMS (ISO 27001), QMS (ISO 9001)
AIDLC Application:
- Inception: Plan (risk assessment & policy establishment)
- Construction: Do + Check (implementation, validation, monitoring)
- Operations: Act (improvement & corrective actions)
Korea AI Framework Act (AI 기본법, 2026)
Key Features:
- In force since 22 January 2026
- Advance user notification required when using high-impact or generative AI (high-impact AI also requires safety measures including an impact assessment; detailed criteria set in the enforcement decree)
- Labeling obligation for generative AI (watermark/metadata recommended)
- Cross-compliance with PIPA/ISMS-P
AIDLC Application:
- Inception: Impact assessment (high-impact AI determination — by statutory domain)
- Construction: Transparency labeling for AI-generated code
- Operations: Post-deployment management (malfunction correction, major incident reporting)
Comparative Matrix
Control-Level Regulatory Mapping
| Control Element | EU AI Act | NIST AI RMF | ISO/IEC 42001 | Korea AI Basic Act |
|---|---|---|---|---|
| Risk Assessment | Art. 6, 9 (risk mgmt) | MAP 5.1 | A.5.1 (policy), A.10.2 (risk mgmt) | Impact assessment (high-impact AI) |
| Data Governance | Art. 10 (data quality) | MAP 2.3 | A.7.* (12 data controls) | PIPA compliance |
| Transparency & Explainability | Art. 13 (transparency) | MEASURE 2.8 / 2.9 | A.8.2 (transparency), A.8.3 (explanation) | Generative AI labeling obligation |
| Human Oversight (HITL) | Art. 14 (human oversight) | MAP 3.5 | A.10.5 (human intervention) | Art. 34(1)(4) (human management and supervision of high-impact AI) |
| Technical Documentation | Art. 11 (documentation) | GOVERN 1.4 | A.8.1 (docs), A.10.6 (records) | Art. 34(1)(5) (preparing and storing documents on safety and reliability measures, high-impact AI) |
| Performance Monitoring | Art. 15 (accuracy) | MEASURE 2.3 / 2.4 | A.11.1 (performance metrics) | - |
| Post-Market Monitoring | Art. 72 (post-market) | MANAGE 4.1 | A.10.10 (continuous monitoring) | Post-deployment mgmt obligation |
| Incident Reporting | Art. 73 (without undue delay; generally 15 days / 2 days widespread or severe / 10 days where a death is involved; high-risk providers) | MANAGE 4.3 | A.10.11 (incident response) | Major incident reporting |
| Security | Art. 15 (cybersecurity) | MEASURE 2.7 | A.12.* (10 security controls) | ISMS-P integration |
| Supply Chain Management | - | GOVERN 6.1 / MANAGE 3.1 | A.13.* (6 third-party controls) | - |
The control identifiers in the ISO/IEC 42001 column have not been checked against the (paid) normative text (as of 2026-10-29). Public secondary guides describe Annex A as 38 controls under nine control objectives A.2-A.10, so confirm the identifiers in this column (including A.11-A.13) against the standard before using them as certification or audit evidence. A - in the Korea AI Basic Act column means no article in the Act's text directly sets that control; the enforcement decree and notices were not checked.
